Terms of Service

Effective March 27, 2026

These terms govern your use of Aevia ("the Service"), a personalized adaptive nutrition platform ("we," "us," "our"). Aevia is operated by Livekick Inc., a Delaware corporation headquartered in Miami Beach, Florida. By accessing or using Aevia, you agree to these terms. If you do not agree, do not use the Service.

1. The Service and Important Disclaimers

Aevia generates personalized nutrition recommendations based on health and wellness information you provide. The Service analyzes your inputs (such as age, biological sex, health conditions, activity level, medications, dietary preferences, and wellness goals) and provides meal recommendations, portion guidance, and timing tailored to your profile. Recommendations are generated using artificial intelligence and should be viewed as informational guidance only.

Aevia Does Not Order Food. Aevia recommends meals and provides information about where to find them. Aevia does not place orders, arrange delivery, or directly purchase food on your behalf. You are responsible for all ordering decisions, whether through third-party delivery platforms, meal prep providers, grocery services, or local restaurants. Aevia's recommendations are informational only.

Not a Medical Device, Medical Service, or Diagnosis Tool. Aevia is a wellness recommendation platform, not a medical device, medical service, or diagnostic tool. It does not diagnose, treat, cure, or prevent any disease or medical condition. The recommendations provided are informational and educational in nature. They do not constitute personalized medical advice, and should not replace consultation with a qualified healthcare provider.

Health Claims Disclaimer. Aevia does not claim to diagnose, prevent, treat, or cure any disease or medical condition. We make no claims that Aevia will improve your health, manage existing conditions, or produce any specific health outcome. Individual results vary widely and depend on many factors beyond Aevia's recommendations, including your adherence, overall lifestyle, genetics, medical history, and professional medical care. Educational content on our Science page is provided for informational purposes only and should not be interpreted as medical advice.

HIPAA Non-Applicability. Aevia is not a covered entity under the Health Insurance Portability and Accountability Act (HIPAA), and the Service is not a HIPAA-regulated system. Your use of Aevia does not create a doctor-patient relationship or a covered relationship under HIPAA. Your health information is protected under our Privacy Policy and applicable state and federal privacy laws, but not under HIPAA privacy and security requirements.

Always Consult Your Healthcare Provider. Before using Aevia, and especially before making significant changes to your diet, supplement regimen, medication timing, or lifestyle, you must consult a qualified healthcare provider. This is essential if you have existing health conditions, take medications, have allergies, are pregnant or nursing, have a history of eating disorders, or are under medical supervision. Aevia recommendations are not a substitute for professional medical advice.

2. Early Access Status

Aevia is currently in early access and pre-launch phase. The Service is provided on an experimental, "as is" basis. Functionality, availability, features, and user experience may change materially without notice. Data loss, service interruptions, and unexpected behavior are possible. We strongly encourage you to review your expectations about service stability and reliability before providing sensitive health information.

3. AI-Generated Content and Limitations

Artificial Intelligence Disclosure. Aevia uses artificial intelligence, including large language models operated by Anthropic, to generate personalized recommendations in response to your questions and protocol guidance. The scoring engine that ranks and orders meal recommendations is a deterministic algorithm, not AI-generated. However, conversational responses and health protocol guidance are generated by AI and may contain inaccuracies, outdated information, or recommendations that do not account for your full health picture or individual circumstances.

No Warranty of Accuracy. We make no representation that AI-generated recommendations are accurate, complete, current, or suitable for your specific situation. While we work to incorporate peer-reviewed research and evidence-based clinical frameworks, AI systems can make errors. You should independently verify any important nutritional, health, or medical claims before acting on them.

Lack of Medical Oversight. Recommendations from Aevia are not reviewed by a human healthcare provider before being presented to you. No licensed physician, registered dietitian, or other healthcare professional has reviewed your specific health data in the context of the Service. This is a key distinction from professional medical or nutritional consultation.

4. Wearable Integrations and Health Data Sources

Apple HealthKit Integration. If you choose to connect your Apple HealthKit account to Aevia, you authorize us to access and use specific health data from your HealthKit, including activity data, workout information, nutrition data, sleep metrics, and other data types you approve. You may revoke this access at any time through your device settings. We collect this data to enhance your personalized recommendations. For more details on how we handle HealthKit data, see our Privacy Policy. Apple's terms and privacy practices also apply when you use HealthKit integration.

Wearable Device Data. If you connect wearable devices (such as Apple Watch, Oura Ring, or continuous glucose monitors) to Aevia through HealthKit or direct integrations, you consent to our collection and use of data from those devices to improve your personalized recommendations. You retain control over which data sources connect to Aevia and may disconnect devices at any time. Wearable data is processed subject to our Privacy Policy and the privacy policies of the device manufacturers.

Data Processing in the United States. Your health data from all sources is processed, stored, and analyzed primarily in the United States using AWS infrastructure located in the US. By using Aevia, you consent to this US-based data processing.

User Data Ownership and Portability. You own your health data and personalized profile. You have the right to request a copy of your data in a portable, machine-readable format at any time by contacting hello@tryaevia.com. You also have the right to request deletion of your account and all associated data. See our Privacy Policy for details on how to exercise these rights.

5. Third-Party Services and Integrations

Delivery Platforms and Meal Prep Providers. Aevia provides recommendations from a catalog that includes restaurants and meal sources available through DoorDash, Uber Eats, Toast, Grubhub, Caviar, Instacart, Whole Foods, FreshDirect, Walmart+, Amazon Fresh, and meal prep providers including ACKitchen, Sakara Life, Factor, Trifecta, Green Chef, and Thistle, among others. Aevia does not own, operate, or control these third-party platforms or providers. We are not responsible for their food quality, preparation, delivery accuracy, allergen handling, customer service, or business practices. You are responsible for reviewing the terms, policies, and ratings of any third-party service before ordering. Aevia makes no warranty regarding third-party food safety, ingredients, nutritional accuracy, or delivery performance.

AWS Infrastructure. Aevia is hosted on and operated through Amazon Web Services (AWS). AWS processes and stores your data according to their terms of service and privacy policies. By using Aevia, you acknowledge AWS's role as a data processor. For details on AWS data handling, see their Privacy Notice.

Anthropic and AI Models. Aevia uses artificial intelligence services provided by Anthropic, including access to their language models for chat, recommendations, and protocol generation. Your health data and profile information may be processed by Anthropic's systems as necessary to generate responses. Anthropic's privacy policies and terms apply to this processing. Anthropic may retain data as specified in its privacy policies, though we work with Anthropic to minimize retention where possible. See Anthropic's terms and privacy documentation for full details.

Google Tag Manager. Aevia uses Google Tag Manager (GTM) for analytics and performance monitoring. GTM may collect usage data, device information, and interaction patterns. See Google's privacy policies for details on how Google collects and processes this data.

No Endorsement. Our use of third-party services does not constitute an endorsement of those services, and we are not responsible for their practices, policies, or any issues arising from your use of their systems.

6. Chat Interface and AI Responses

Conversational AI. The chat interface on Aevia allows you to ask health and nutrition questions and receive AI-generated responses. These responses are created by Anthropic's language models and are not reviewed by a healthcare professional before delivery. Responses may contain errors or information that is not applicable to your individual circumstances.

Chat Limitations. Chat responses are informational and educational only. They are not a substitute for professional medical advice, diagnosis, or treatment. Never rely solely on chat responses for critical health decisions. Always verify important health information with a qualified healthcare provider.

7. Eligibility

You must be at least 18 years old to use Aevia and to consent to these terms. By creating an account or using the Service, you represent and warrant that you are at least 18 years old and legally capable of entering into this agreement.

8. Your Account and Authentication

OTP Authentication. You authenticate via one-time verification codes (OTP) sent to your phone number or email address. You are responsible for maintaining secure access to the phone number or email associated with your account. We do not store passwords.

Passkey Authentication. Aevia supports WebAuthn/passkey authentication for enhanced security. By enrolling a passkey, you authorize us to store your passkey credential in a secure, encrypted database. Your biometric authentication occurs locally on your device. You may remove enrolled passkeys at any time through your account settings.

Account Information Accuracy. You agree to provide accurate, complete, and current information during onboarding and protocol setup. Inaccurate health information may result in recommendations that are unsuitable for you and could potentially be harmful. You are responsible for the accuracy of your health inputs.

Account Responsibility. You are responsible for all activity on your account, including any unauthorized access. You agree to notify us immediately of any unauthorized use by emailing hello@tryaevia.com.

9. Subscription, Billing, and Refunds

Subscription Plans. Aevia offers subscription plans on a signal-based pricing model, including free trial and monthly paid tiers. Specific pricing, features, and plan terms are displayed at the time of purchase and in your account settings.

Billing. By subscribing to Aevia, you authorize us to charge your payment method on a recurring monthly basis. Billing occurs on the date you subscribe and on the same date each month thereafter unless you cancel. You are responsible for keeping your payment information current and accurate.

Refunds. We do not offer refunds for monthly subscriptions. However, you may cancel your subscription at any time, and you will not be charged for future months. Cancellation takes effect at the start of your next billing cycle. For early access users, we will work with you on a case-by-case basis for unusual circumstances.

Changes to Pricing. We may change subscription pricing from time to time. Changes will be communicated at least 30 days before taking effect. Continued subscription after the change date constitutes your acceptance of the new pricing.

10. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to reverse-engineer, decompile, disassemble, or derive the underlying algorithms, AI models, scoring systems, or proprietary methodology of Aevia.
  • Scrape, crawl, or extract data, recommendations, algorithms, or intellectual property from the Service.
  • Interfere with, disrupt, disable, overload, or otherwise harm the Service's infrastructure, servers, or networks.
  • Create multiple accounts using automated means, bots, false identities, or deceptive practices.
  • Redistribute, resell, share, sublicense, or commercialize access to the Service, recommendations, or outputs without our written permission.
  • Use the Service to train, develop, or improve competing AI systems or recommendation engines.
  • Transmit any malware, viruses, or code intended to damage or disrupt the Service.
  • Harass, threaten, defame, or spam other users or our team members.
  • Violate the intellectual property, privacy, or other rights of Aevia or third parties.

11. Intellectual Property

Our IP. All content, algorithms, designs, user interface, software, databases, scoring systems, AI models, methodologies, trade secrets, and intellectual property comprising Aevia are owned by Aevia and its parent company or licensed partners. Your use of the Service does not grant you any ownership interest in our intellectual property.

Your Data. You retain ownership of the personal health data and profile information you provide to Aevia. However, by submitting data to us, you grant us a worldwide, royalty-free, non-exclusive license to use your de-identified or aggregated data for service improvement, research, and algorithm training, subject to your privacy settings and our Privacy Policy.

License to You. We grant you a limited, non-exclusive, non-transferable, revocable license to use Aevia solely for your personal, non-commercial wellness purposes. This license does not include the right to modify, translate, adapt, or create derivative works based on the Service.

Third-Party Trademarks. Aevia's website and service may reference third-party brand names, logos, and trademarks, including but not limited to restaurant names, delivery platforms (such as DoorDash, Uber Eats, Grubhub, Caviar, and Toast), meal prep providers (such as Sakara Life, Factor, and Trifecta), grocery services (such as Instacart, Whole Foods, FreshDirect, and Amazon Fresh), wearable device manufacturers (such as Apple, Oura, and Whoop), and food establishments. All third-party trademarks, service marks, trade names, and logos are the property of their respective owners. Their appearance on Aevia does not imply endorsement, sponsorship, or affiliation with Aevia unless expressly stated. We use these marks solely for informational and identification purposes.

12. SMS and Email Communications

SMS Verification. By providing your phone number and clicking "Send Code" or similar, you expressly consent to receive one-time verification (OTP) codes via SMS from Aevia (operated by Livekick Inc.) for account authentication purposes only. Message frequency varies based on your login activity (typically one message per sign-in attempt). Standard carrier messaging and data rates may apply. You may opt out of SMS at any time by replying STOP to any message, though this may prevent you from logging into your account via SMS. Reply HELP for assistance, or contact us at hello@tryaevia.com. Consent to receive SMS messages is not a condition of purchase or use of the Service. We do not send marketing, promotional, or unsolicited messages via SMS. Your phone number is used solely for authentication and is never shared with or sold to third parties for marketing or any other purpose. For details on how we handle your data, see our Privacy Policy.

Email Authentication and Transactional Messages. By providing your email address, you consent to receive one-time verification codes and transactional emails related to your account (such as password resets, security alerts, and account updates). We do not send marketing or promotional emails unless you separately and explicitly opt in. You may manage your email preferences in your account settings.

No Pre-Authorization for Marketing. Creating an account does not automatically enroll you in any mailing list or marketing communications. Any marketing communications will only be sent if you explicitly consent to receive them.

13. Automated Decision-Making

Aevia uses automated algorithms and artificial intelligence to generate personalized recommendations without human review. These algorithms make autonomous decisions about which meals, timing, and protocols to recommend to you based on your input data. You acknowledge that these recommendations are generated automatically and may not account for nuances in your health situation that a human healthcare provider would consider.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIVEKICK INC. DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, AND ACCURACY.

Nutritional Science Disclaimer. Nutritional science is complex, evolving, and highly individualized. While Aevia incorporates current peer-reviewed research and evidence-based frameworks, scientific understanding changes. We cannot guarantee that recommendations are current, complete, or applicable to your unique circumstances. We make no warranty that using Aevia will produce any specific health benefit or outcome.

Catalog Availability. Aevia's catalog of indexed dishes and meal options varies by location and changes over time. Availability is not guaranteed and depends on third-party platform and provider availability. Nutritional data, pricing, and meal descriptions may be inaccurate or outdated. We make no warranty regarding catalog accuracy or completeness.

Service Availability. We make no warranty that the Service will be uninterrupted, error-free, secure, or meet your expectations. Service may be temporarily unavailable for maintenance, updates, or due to unforeseen technical issues.

No Responsibility for User-Generated Health Decisions. We are not responsible for any health decisions you make based on Aevia recommendations, or any adverse health effects resulting from following recommendations without appropriate medical supervision.

15. Limitation of Liability

Exclusion of Consequential Damages. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIVEKICK INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ADVERSE HEALTH EFFECTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Limitation of Direct Damages. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100. THIS LIMITATION APPLIES EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Essential Term. You acknowledge that this limitation is a material and essential term of these terms of service, and that we would not provide the Service without such limitation.

16. Indemnification

You agree to indemnify, defend, and hold harmless Aevia, its parent company, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your violation of these terms, (b) your use or misuse of the Service, (c) your health data or representations about your health, (d) your health decisions made based on Aevia recommendations, (e) claims by third parties related to your use of the Service, or (f) infringement of any intellectual property or other rights of third parties caused by your use of the Service.

17. Termination and Data Handling

Your Right to Terminate. You may stop using Aevia at any time. You may request deletion of your account and all associated data by emailing hello@tryaevia.com. We will process deletion requests in accordance with our Privacy Policy.

Our Right to Terminate. We may suspend or terminate your access to the Service, with or without notice, if: (a) you violate these terms, (b) we determine that your account poses a security or operational risk, (c) we are required to do so by law or legal process, or (d) we cease offering the Service entirely. Upon termination, your right to use the Service immediately ceases.

Service Shutdown. If we discontinue Aevia or cease providing the Service, we will provide you at least 30 days' notice. During this period, you will have the right to request a full export of your data in a portable, machine-readable format. After the shutdown period, we will delete your personal data in accordance with our Privacy Policy.

Survival. The following sections survive termination: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature are intended to survive.

18. Governing Law and Jurisdiction

These terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles. You agree that any dispute, claim, or legal proceeding arising from or related to these terms or the Service shall be brought exclusively in the state and federal courts located in Miami-Dade County, Florida. You consent to personal jurisdiction in those courts and waive any objection to venue. Both parties agree to attempt good-faith resolution before pursuing formal litigation.

19. Force Majeure

Aevia shall not be liable for any failure or delay in performance of its obligations under these terms arising from causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, pandemics, governmental actions, internet outages, or third-party service failures. This does not relieve us of our obligation to maintain data security or respect your privacy rights.

20. Severability

If any provision of these terms is found to be invalid, unlawful, or unenforceable by a court, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed. The remaining provisions shall remain in full force and effect. If any provision cannot be modified or severed without materially altering these terms, the parties agree to renegotiate in good faith.

21. Entire Agreement

These terms of service, together with our Privacy Policy, constitute the entire agreement between you and Aevia with respect to your use of the Service and supersede all prior and contemporaneous agreements, understandings, and negotiations, whether written or oral. If you have signed a separate written agreement with us specifically relating to the Service, that agreement shall control to the extent it conflicts with these terms.

22. Changes to These Terms

We may update these terms from time to time to reflect changes in the Service, legal requirements, or other business reasons. Material changes will be communicated to you by email or by posting a prominent notice in the Service with an updated effective date. Your continued use of the Service after the effective date of any change constitutes your acceptance of the updated terms. If you do not accept the updated terms, you must stop using the Service.
